NHLPA files unfair labor practice charge

  • NEW YORK (AP)—The NHL players’ association on Tuesday filed an unfair labor practice charge with the National Labor Relations Board regarding negotiations with clubs over European player releases.

    The latest move by the union followed notification that it lost a grievance challenging the NHL’s institution of defected player status on drafted and unsigned European players.

    That came about because of a lack of an International Ice Hockey Federation transfer agreement between the NHL and hockey federations in some European countries.

    The filing of the charge with the NLRB was confirmed by union spokesman Jonathan Weatherdon. The NHLPA declined to comment further because of the ongoing legal matter.

    The New York Post first reported the union’s action Tuesday on its Web site.

    In the last collective bargaining agreement between the NHL and the players’ association, the union fought for European players to have the same rights as their North American counterparts.

    The union’s loss of the grievance gives teams permanent rights to these European players as long as there is a lack of an IIHF transfer agreement between the NHL and international hockey federations. The NHLPA is trying to avoid reverting to a time when the NHL controlled the rights of European players forever.

    The charge by the players’ association against the NHL said: “Since on or about June 26, 2008, (the NHL) has failed and refused to bargain with the NHLPA over a mandatory subject of bargaining by unilaterally implementing a rule substantially modifying and restricting the manner in which players under contract to European Clubs may gain employment (in the NHL), without first providing notice to, or bargaining to agreement or good-faith impasse with the NHLPA,” the New York Post reported.

    Testimony by NHL deputy commissioner Bill Daly was crucial in the NHLPA losing its grievance. Daly and former union executive director Ted Saskin agreed in a letter on July 22, 2005, to temporarily adopt defected player status for Europeans since an IIHF transfer agreement wasn’t in place.

    That agreement expired and the union didn’t want to extend it, but the NHL sent a memo on May 19 to the 30 general managers to advise them that it was putting the defected players status back in effect, the Post said.

Devils lose Brodeur

  • Martin Brodeur will have to wait longer to break the NHL records after tearing a distal biceps in his left elbow last weekend.  He will be out for 3-4 months.  He will undergo surgery Thursday.

  • Barry Trotz coached his 750th game, all with Nashville, becoming the 31st NHL coach to reach that milestone and just the 10th to do so with the same team.

Top News:

  • Wild reportedly shopping RW Gaborik
    Arguably the greatest player in franchise history, Marian Gaborik appears to be on his way to becoming a former member of the Minnesota Wild.

    Gaborik, who can become an unrestricted free agent following the 2008-09 season, was offered by the Wild to an unnamed team in a trade proposal last weekend, according to a report by the Minneapolis Star Tribune on Tuesday.

    The report stated its source, an NHL team executive, told Minnesota he was not interested in acquiring Gaborik, the lone remaining original member of the Wild.

    It is believed Minnesota general manager Doug Risebrough has had discussions with the Montreal Canadiens and Los Angeles Kings regarding Gaborik, the Star Tribune reported. The right wing has turned down a number of contract extension offers, and Risebrough and agent Ron Salcer both told the Star Tribune the sides have not spoken in two weeks.

    Drafted third overall in 2000, Gaborik has recorded 207 goals and 415 points - both franchise highs - in 487 career games with the Wild. This season, the 26-year-old Slovakian notched one tally in two contests before missing the team’s last two games with a “lower body” injury.

    A two-time All-Star, Gaborik has reached the 30-goal mark five times during his seven seasons in the NHL, netting a career-high 42 in 2007-08. He also represented his country at the 2006 Winter Olympics.

Injury Updates:

  • Red Wings D Lilja undergoes appendectomy
    Red Wings defenceman Andreas Lilja has undergone an appendectomy.  The team says Lilja could return to the lineup as soon as Friday following Tuesday’s surgery at the Detroit Medical Center. The team also says forward Darren Helm has been assigned to the American Hockey League’s Grand Rapids Griffins. Helm was called up to Detroit on Thursday and appeared in two games.  Helm was Detroit’s fifth-round selection in the 2005 draft.

  • Blue Jackets activate centre Malhotra and place winger Modin on IR
    The Columbus Blue Jackets activated centre Manny Malhotra off injured reserve Tuesday.  He has been nursing a lower-body injury that has kept him out of the lineup through the club’s first five games.  The Blue Jackets also placed left-winger Fredrik Modin on injured reserve with a hip injury. Modin, who has three assists in five games, is expected to miss at least three games.
  • Ducks C Getzlaf out of lineup
    The Anaheim Ducks are without one of their top players for Tuesday’s game against the Toronto Maple Leafs as center Ryan Getzlaf was scratched due to an issue with his teeth.

Signings & Acquisitions:

  • Blues claim LW Koci on waivers from Lightning
    The St. Louis Blues on Tuesday claimed left wing David Koci on waivers from the Tampa Bay Lightning.  Koci, 27, played in one game with Tampa Bay this season, posting four penalty minutes. The 6-6, 238-pounder has skated in 28 career NHL contests, recording 160 penalty minutes.  The Czech Republic native originally was taken by Pittsburgh in the fifth round of the 2000 draft.

  • Rangers place LW Rissmiller on waivers
    Patrick Rissmiller’s days with the New York Rangers could be coming to an end.  According to a report by New York Newsday on Tuesday night, the Rangers placed the left wing on waivers.
  • Ducks place D Klee on waivers
    The Anaheim Ducks on Tuesday placed defenseman Ken Klee on waivers.  Teams have until 9 a.m. Pacific Time on Wednesday to claim the 37-year-old Klee, who could be assigned to Iowa of the American Hockey League should there be no takers.

  • Canucks D Bieksa leaves game with knee injury
    Vancouver Canucks defenseman Kevin Bieksa left Saturday’s 5-4 overtime victory over the Calgary Flames in the first period with a left knee injury.  Bieksa attempted to check the 6-3, 230-pound Wayne Primeau against the boards, but the blue-liner quickly fell to the ice.  He did not return and will be re-evaluated on Sunday.   • Flyers D Jones to be sidelined 3-4 months
    Defenseman Randy Jones will have surgery on a labrum in his hip, and while the 27-year-old estimated he would be sidelined only six to eight weeks, Holmgren had a different assessment. (Yahoo! Sports)
  • New York Islanders defenceman Radek Martinek knocked out of game
    New York Islanders defenceman Radek Martinek left with an undisclosed injury in the first period, following a hard hit behind the net, and didn’t return to the home opener Saturday night. (Yahoo! Sports)
  • Bruins RW Kobasew out indefinitely with fractured leg
    Boston Bruins right wing Chuck Kobasew is out indefinitely with a fractured left leg, an injury he suffered in the team’s season-opening victory over the Colorado Avalanche on Thursday.  Kobasew, who notched two assists and eight penalty minutes in the 5-4 win, said in a published report that a teammate’s dump-in shot in the second period caught him on the ankle, causing the fracture. Suspensions:

  • Michael Peca suspended for bumping official
    Columbus Blue Jackets centre Michael Peca has been suspended indefinitely by the NHL for making contact with an on-ice official.  The team and league announced the suspension on Saturday. Peca was automatically suspended per Rule 41, Physical Abuse of Officials, Category 2.  He was assessed a game misconduct penalty at 5:21 of the second period of the Blue Jackets’ season opener on Friday night at Dallas, which they went on to win 5-4 on Rick Nash’s goal in overtime.   • Sarah Palin drops first puck at Flyers’ home opener
    To a mixture of boos and cheers, Republican vice-presidential candidate Sarah Palin dropped the ceremonial first puck Saturday night at the Philadelphia Flyers’ home opener against the New York Rangers.  The Alaska governor and self-described “hockey mom” heard a few boos when she walked onto the ice, but that soon turned to polite applause as she headed to centre ice with Mike Richards of the Flyers and Scott Gomez - from Alaska - of the Rangers.   • Devils play opener despite arena code dispute
    The New Jersey Devils played their home opener as scheduled Friday night despite a construction code dispute that closed the Prudential Center down this summer.  The team obtained a temporary certificate of occupancy to enable it to play the opener against the New York Islanders, and was closing in on a permanent solution. Devils owner Jeff Vanderbeek said the paperwork required for a permanent certificate was submitted to the City of Newark last week.  “The city is reviewing those documents and we’re both close to getting it done,” Vanderbeek said in a telephone interview. “We could hear back from them as early as next week.” (Yahoo! Sports)
  • Hull among four inducted into U.S. Hockey Hall of Fame
    The Dallas Stars surely can forgive Brett Hull for missing the team’s 2008-09 season opener.  The co-general manager of the Stars, Hull skipped the club’s first game of the campaign Friday in order to be one of four players inducted into the United States Hockey Hall of Fame.  Also inducted during the ceremony at the Magness Arena were Brian Leetch, Mike Richter and Cammi Granato, who was the first woman to receive the honor. The addition of the quartet gives the U.S. Hockey Hall of Fame 138 members. (Yahoo! Sports)

  • TSN.CA reports the Detroit Red Wings have placed defenseman Kyle Quincey on waivers.

  • COURIER POST ONLINE/PHILADELPHIA INQUIRER: reports Flyers defenseman Randy Jones is facing hip surgery which could sideline him for between six-eight weeks. With Ryan Parent also sidelined by injury GM Paul Holmgren is examining his options, which includes shopping for a veteran defenseman, which Holmgren suggests could cost him a forward. Holmgren also noted that he didn’t claim veteran blueliner Kyle McLaren off waivers as the Flyers have salary cap issues.

  • USA TODAY: Kevin Allen reports veteran NHL defenseman Bryan Berard is considering his options, which includes possibly signing with a team in Russia’s Kontinental Hockey League.
  • EDMONTON JOURNAL: David Staples reports Pittsburgh Penguins forward Evgeni Malkin confirmed he rejected an $11 million contract offer from his former Russian team to re-sign with the Pittsburgh Penguins, telling them “I’m not (Alexander) Radulov”.
  • MLIVE.COM: Ansar Khan reports Detroit Red Wings forward Darren McCarty is eligible to come off short term injury reserve in a week, leaving management with three options. One is demoting McCarty, trading defenseman Kyle Quincey or placing him on waivers.

The Edmonton Oilers have done a trade with the L.A. Kings, which sends Lubimir Visnovsky (D) to the Oilers in exchange for Jarret Stoll (F) and Matt Greene (D).

Tampa Bay have acquired the rights to Ryan Malone and Gary Roberts from the Penguins, and also Brian Rolston of the Minnesota Wild.

NHL Signings:

The Dallas Stars have signed Loui Eriksson (F) to a 2-year extension.

Boston Bruins have signed Mark Stuart (D) to a 2-year extension.

Carolina Hurricanes signed forward, Tuomo Ruutu to a 1-year, $2.25 Million contract.

Nashville Predators signed Dan Ellis (G) to a 2-year $3.5 Million contract, and also Shae Weber to a 3-year $13.5 Million contract.

Ottawa Senators re-signed Chris Kelly (C) to a 4 year contract.

Moves:

Ottawa Senators placed Ray Emery on Waivers, then bought him out, making Emery a free agent.

Anaheim Ducks placed Todd Bertuzzi (F) on waivers, with plans to buy him out.

Toronto Maple Leafs bought out Andrew Raycroft (G)

Rumors:

Philadelphia Flyers are rumored to have signed Jeff Carter (C) to a 3-year $13.5 Million contract.

Calgary Flames are rumored to have locked up Conroy (C), Langkow (C), Nystrom (LW) and McElhinney (G).

Brooks Orpik is rumoured to be looking to the free agency market instead of re-signing with the Penguins.
