NHLPA files unfair labor practice charge
- NEW YORK (AP)—The NHL players’ association on Tuesday filed an unfair labor practice charge with the National Labor Relations Board regarding negotiations with clubs over European player releases.
The latest move by the union followed notification that it lost a grievance challenging the NHL’s institution of defected player status on drafted and unsigned European players.
That came about because of a lack of an International Ice Hockey Federation transfer agreement between the NHL and hockey federations in some European countries.
The filing of the charge with the NLRB was confirmed by union spokesman Jonathan Weatherdon. The NHLPA declined to comment further because of the ongoing legal matter.
The New York Post first reported the union’s action Tuesday on its Web site.
In the last collective bargaining agreement between the NHL and the players’ association, the union fought for European players to have the same rights as their North American counterparts.
The union’s loss of the grievance gives teams permanent rights to these European players as long as there is a lack of an IIHF transfer agreement between the NHL and international hockey federations. The NHLPA is trying to avoid reverting to a time when the NHL controlled the rights of European players forever.
The charge by the players’ association against the NHL said: “Since on or about June 26, 2008, (the NHL) has failed and refused to bargain with the NHLPA over a mandatory subject of bargaining by unilaterally implementing a rule substantially modifying and restricting the manner in which players under contract to European Clubs may gain employment (in the NHL), without first providing notice to, or bargaining to agreement or good-faith impasse with the NHLPA,” the New York Post reported.
Testimony by NHL deputy commissioner Bill Daly was crucial in the NHLPA losing its grievance. Daly and former union executive director Ted Saskin agreed in a letter on July 22, 2005, to temporarily adopt defected player status for Europeans since an IIHF transfer agreement wasn’t in place.
That agreement expired and the union didn’t want to extend it, but the NHL sent a memo on May 19 to the 30 general managers to advise them that it was putting the defected players status back in effect, the Post said.
Devils lose Brodeur
- Martin Brodeur will have to wait longer to break the NHL records after tearing a distal biceps in his left elbow last weekend. He will be out for 3-4 months. He will undergo surgery Thursday.

- Investigator: Hockey player had heart problems
Alexei Cherepanov had heart problems and probably should not have been allowed to play in a game in which he collapsed and died, a regional investigator suggested Tuesday.
Yulia Zhukova said Cherepanov, who died Monday playing for Avangard Omsk in a Continental Hockey League game outside of Moscow, apparently had chronic ischemia—a medical condition when not enough blood gets to the heart or other organs.
“Checks will be conducted to clarify, in particular, why the sportsman with such an illness went onto the ice,” Zhukova said. (Read the full article)

- Radulov says he wants to stay in Russia and help grow sport in his country
With the NHL and Russia’s new Continental Hockey League in a dispute over Alexander Radulov, the forward says he wants to stay home and help grow the sport of hockey in his own country.
“I returned to Russia not so that I could return again to the NHL but rather to offer all of my efforts and professionalism to the betterment of Russian hockey taking it to a new level,” according to a translation of the letter attributed to Radulov and provided by the KHL.
Radulov wrote the letter to KHL president Alexander Medvedev possibly to end some mixed signals on whether he wanted to return to the NHL. (read the full article)
- Red Wings visit White House
Less than 24 hours after posting a road victory over Carolina, the Detroit Red Wings traveled north to visit the President.
The defending Stanley Cup champion Red Wings on Tuesday visited the White House and were honored by President George W. Bush in a ceremony for the second time.

- DENVER POST: Terry Frei reports Colorado Avalanche goalie Peter Budaj must step up his performance to sew up the starting goaltender role with the club. - Red Wings’ Chelios out 3 – 6 weeks
DETROIT (AP)—Red Wings defenseman Chris Chelios will be sidelined three to six weeks with a fractured shin bone. The 46-year-old Chelios is the NHL’s oldest player. He is entering his 25th NHL season and his 10th with Detroit. The team says Chelios was injured while blocking a shot during the third period of Tuesday night’s 2-1 preseason loss to Montreal. - Predators’ Legwand should play friday

TSN of Canada reported on Thursday that Khabibulin’s agent, Jay Grossman, told the web site the veteran goaltender is taking a closer look at the Kontinental Hockey League. “Nik has several options, both here and over there,” Grossman told TSN. “However, nothing has been finalized and by no means is anything imminent.” (sports.yahoo.com)

PRAGUE, Czech Republic – The NHL is giving two more countries a first look at regular-season games this weekend, and it’s a sight Europeans should be getting used to. - Allen Panzeri reports Senators GM Bryan Murray is set to meet with the agent for team captain Daniel Alfredsson on Saturday to discuss a contract extension.
- Stephen Harris reports Bruins GM Peter Chiarelli denied a report in yesterday’s Herald that top center Marc Savard might be traded. “We’re not looking to trade Marc Savard,” said Chiarelli, who didn’t rule out other deals. “There’s a chance. I’m looking to improve the team. I’ve had a couple of discussions, more than a couple.”
- Joe Haggerty (under the “This Just In” segment) recently reported Chiarelli said there was a “better than fifty percent chance” that he could make a trade prior to the start of the NHL season on October 9th.
- The Chicago Blackhawks are prepared to loan goaltender Nikolai Khabibulin to a Russian team in order to remove his $6.75 million salary from their payroll. Negotiations are believed ongoing but it has yet to be determined which KHL team he could be loaned to, although it’s believed HC Dinamo Minsk of Belaruscould have the inside track as Khabibulin is believed to have family there.
- Craig Custance reports Atlanta Thrashers forward Ilya Kovalchuk denied speculation he was growing unhappy with the club and might try to seek a trade prior to the end of his contract in two years time. Kovalchuk maintains he wants to try to turn the Thrashers into a winner over that time.
