PHOENIX (AP)—The Coyotes are staying in Phoenix, at least for now.
A bankruptcy judge has rejected the proposed sale of the franchise to Canadian billionaire Jim Balsillie, who would have moved the team to Hamilton, Ontario.
Judge Redfield T. Baum issued a 21-page ruling late Monday afternoon, concluding the June 29 deadline imposed by Balsillie did not allow enough time to resolve the complex case.
“Simply put, the court does not think there is sufficient time (14 days) for all of these issues to be fairly presented to the court given that deadline,” the judge wrote.
The ruling is a victory for the NHL, which had argued Balsillie was using the U.S. Bankruptcy Court to make an end-run around the league’s rules over who owns teams and where they are located.
“We’re pleased the court recognized the validity of league rules and our ability to apply them in a reasonable fashion,” NHL deputy commissioner Bill Daly said in a statement Monday night. “We will turn our attention now toward helping to facilitate an orderly sales process that will produce a local buyer who is committed to making the Coyotes’ franchise viable and successful in the Phoenix-Glendale area. We are confident that we will be able to find such a buyer for the Coyotes and that the claims of legitimate creditors will be addressed.”
But Balsillie, who has failed in two other bids to buy NHL teams, refused to concede defeat, saying he wants to work with the league and move the franchise.
“We look forward to hearing from the NHL soon on its view of our relocation application and an appropriate relocation fee, so as to allow the court to determine if that fee is reasonable,” Balsillie spokesman Bill Walker said. “We still think there is enough time for the NHL to approve Mr. Balsillie’s application and move the team to Hamilton by September.”
Walker said the judge’s ruling “invited mediation.”
“Mr. Balsillie is willing to participate in such mediation if the NHL is also willing to do so,” Walker’s statement said.
Baum called the case unprecedented in U.S. bankruptcy history.
“The legal issues trigger not only bankruptcy law, but antitrust law and commercial law in the context of a professional sports team, as a Chapter 11 debtor, which team has for years incurred, and is continuing to incur, very serious financial losses and problems,” Baum wrote. “No cases have been found that precisely or even closely fit this scenario.”
Walker’s statement ignored several aspects of the ruling that were made against Balsillie.
Baum shot down the claim by Coyotes owner Jerry Moyes and Balsillie that failure to allow the team, over the objection of the NHL, to move would violate antitrust law.
“This court can not find that antitrust law, as applicable nonbankruptcy law, permits the sale free and clear of the relocation rights of the NHL,” Baum wrote.
He added, “It is not an antitrust violation for professional sports leagues to have terms and conditions on relocations of its members.”
An antitrust claim requires a “bona fide dispute,” but there is none because Balsillie only sought the NHL’s permission to relocate the franchise after it was brought up in court, Baum wrote.
“This court is unconvinced that it should order that the NHL must decide the relocation application to meet the June 29 deadline,” the judge wrote.
Baum also rejected claims by Moyes and Balsillie that while assuming the contract the Coyotes have with the NHL, they can disregard the portion of the agreement that requires the games be played in Glendale.
The judge compared that claim to “a purchaser of a bankrupt franchise in a remote location asserting that it can be relocated far from its original agreed site to a highly valuable location, for example New York City’s Times Square …”
The judge’s decision is also a win for the city of Glendale, which had spent $183 million to build an arena for the Coyotes and had contended the franchise could not use bankruptcy to evade its lease.
Baum said that because he was rejecting the motion, he need not rule at this time on whether Moyes and Balsillie could void Glendale’s lease. The city said it was pleased with the ruling.
“Clearly the court recognized the significance of these issues and the unique interests of the City of Glendale and its taxpayers,” the city said in a statement. “The court based its decision on the law and facts and not on countless rumors and innuendo regarding this matter.”
This is the third time Balsillie—whose company makes the Blackberry—has tried to buy an NHL team. His made previous attempts to purchase the Pittsburgh Penguins and Nashville Predators.
Moyes took the NHL by surprise when he filed for Chapter 11 bankruptcy on May 5, proposing to sell the team to Balsillie for $212.5 million, contingent on the franchise moving to Hamilton, Ontario.
The NHL said that commissioner Gary Bettman was on his way to deliver a letter of intent to Moyes from Jerry Reinsdorf, owner of baseball’s Chicago White Sox and the NBA’s Chicago Bulls, to purchase the team and keep it in Glendale. However, any bid to buy the team will be far less than the offer Balsillie made.
“I think people are going to be shocked when they see the value of this team remaining in Glendale,” Moyes’ attorney Thomas Salerno said. “It’s going to be materially less than the offer we have on the table.”
Salerno said Moyes is disappointed and is evaluating his options. Moyes says he has more than $300 million invested in the team and would have recouped about $100 million if the Balsillie sale had gone through.
The NHL says four parties, including Reinsdorf, have filed preliminary applications to investigate purchasing the team and keeping it in Arizona. However, if no buyer can be found, the league would look to relocate the franchise.
Moyes and Balsillie contended that the team would never succeed in Arizona and would flourish in hockey-crazy Ontario. But the move raised territorial rights issues because of the proximity of the Toronto Maple Leafs and Buffalo Sabres.
Baum had raised the specter of a fee due to the NHL and the two teams if the franchise moved.
The Coyotes have lost more than $300 million since the franchise moved from Winnipeg, Manitoba, in 1996, and at least $36 million each of the last three seasons, but the NHL contends the franchise can be viable with better management and more success on the ice.

NHLPA files unfair labor practice charge
NEW YORK (AP)—The NHL players’ association on Tuesday filed an unfair labor practice charge with the National Labor Relations Board regarding negotiations with clubs over European player releases.
The latest move by the union followed notification that it lost a grievance challenging the NHL’s institution of defected player status on drafted and unsigned European players.
That came about because of a lack of an International Ice Hockey Federation transfer agreement between the NHL and hockey federations in some European countries.
The filing of the charge with the NLRB was confirmed by union spokesman Jonathan Weatherdon. The NHLPA declined to comment further because of the ongoing legal matter.
The New York Post first reported the union’s action Tuesday on its Web site.
In the last collective bargaining agreement between the NHL and the players’ association, the union fought for European players to have the same rights as their North American counterparts.
The union’s loss of the grievance gives teams permanent rights to these European players as long as there is a lack of an IIHF transfer agreement between the NHL and international hockey federations. The NHLPA is trying to avoid reverting to a time when the NHL controlled the rights of European players forever.
The charge by the players’ association against the NHL said: “Since on or about June 26, 2008, (the NHL) has failed and refused to bargain with the NHLPA over a mandatory subject of bargaining by unilaterally implementing a rule substantially modifying and restricting the manner in which players under contract to European Clubs may gain employment (in the NHL), without first providing notice to, or bargaining to agreement or good-faith impasse with the NHLPA,” the New York Post reported.
Testimony by NHL deputy commissioner Bill Daly was crucial in the NHLPA losing its grievance. Daly and former union executive director Ted Saskin agreed in a letter on July 22, 2005, to temporarily adopt defected player status for Europeans since an IIHF transfer agreement wasn’t in place.
That agreement expired and the union didn’t want to extend it, but the NHL sent a memo on May 19 to the 30 general managers to advise them that it was putting the defected players status back in effect, the Post said.

Martin Brodeur will have to wait longer to break the NHL records after tearing a distal biceps in his left elbow last weekend. He will be out for 3-4 months. He will undergo surgery Thursday.

As the February 26 Trade Deadline approaches more and more people will find themselves glued to their TVs, Newspapers, Radios and Computers waiting to hear any news on trades. Not during any other time of the year do we see this kind of absolute mania.
It’s not without reason though. Just look at last year and how, in the closing minutes of the Trade Deadline there was movement galore across the league. This year we don’t expect to be any different.
But the question, before any of this happens, is what position are specific teams in; Buyers or Sellers? Or, in the case of teams with low cap space, both.
Take the top 3 teams in each conference. In the east, Ottawa, New Jersey & Carolina are only holding their spots by 2 points or less. In the West there is a little more space with Detroit, Dallas & Minnesota.
Ottawa Senators: Ottawa have come back to life since the return of Dany Heatley and Daniel Alfredsson. Many believe Ottawa will remain quiet after having already traded away Joe Corvo & Patrick Eaves to the Carolina Hurricanes. If the Senators do make moves, look for them to be buyers.
New Jersey Devils: New Jersey have been strong over their last 10 games (7-1-2). Zack Parise leads the team in Goals, Assists & Points. There are rumours that the Devils are keen to pick up Marian Hossa, however this is to be seen. I don’t personally see them making many moves at the deadline, but if they do they could be buyers for either a solid defenseman or another scorer up front.
Carolina Hurricanes: Having already made a 2 player trade with Ottawa, giving up Mike Commodore & Cory Stillman, the Hurricanes may not be very active come the deadline. If they do, i see them making picking up a 2-way scorer up front.
Detroit Red Wings: Detroit have recently come off a 6 game losing skid, which revealed to the rest of the league that they are not unbeatable. It became clear during that skid that the Red Wings could do with both another scorer up front and another solid defenseman at the blue line. A potential buy/sell trade scenario could be possible here.
Dallas Stars: Co-GMs Brett Hull & Les Jackson have been 2 of the busiest GMs in the league over the last few weeks, having scouted almost every team looking for that special person. Initially it was believed the Stars would be looking for a scoring winger to play with Mike Modano, but it’s possible the Stars could be looking for a solid scoring 2nd line center instead. Modano has been playing solid defensive hockey and would make a killer scoring checking line center, a role the Stars currently have as the 2nd line. If they do pick up a center, look for Modano to keep the Powerplay minutes, and remain an 18min average ice time guy.
Minnesota Wild: Minnesota have a solid forward pack, with the only concern being Marian Gaborik being prone to injuries. The Wild may look to pick up a scoring winger just in case Gaborik goes down.
Special Mention:
Phoenix Coyotes: The Yotes have been making a run for the playoffs all season and currently hold a very unstable 8th spot in the West. The Coyotes rely on youth rather than big names, so it’s really hard to say what Wayne Gretzky’s team will do come the Trade Deadline. I do see the Yotes making moves to buy both a reliable scorer and also another solid blueliner. They do have a LOT of cap space, so it’s possible they could be a big player in the coming days.
Pittsburgh Penguins: The Penguins sniffed the playoffs last year and liked what they smelt. Malkin has stepped up with Crosby out due to injury, so it’s hard to say what they might do. They have a lot of cap space to work with, so maybe strengthening their blueline could be the way they go.

While hockey has it’s darker side with fights and big hits, it is the accidents that make us step back and realise the danger that these guys put themselves in on a daily basis. BUFFALO, N.Y. (AP) — Florida Panthers forward Richard Zednik underwent surgery to close a deep gash on the right side of his neck and was in stable condition Sunday night after he was cut by a teammate’s skate during a game. “The surgery was successful and he’s resting comfortably in the hospital,” Panthers spokesman Brian Goldman said. Blood gushed from Zednik’s neck after he was hurt midway through the third period of Buffalo’s 5-3 victory, creating a frightening moment that delayed the game for about 15 minutes. There was also a brief discussion about postponing the game altogether. Zednik was behind the play and skating into the right corner of the Sabres’ zone, when teammate Olli Jokinen was upended by Sabres forward Clarke MacArthur. Jokinen fell head-first to the ice, and his right leg flew up and struck Zednik directly on the side of the neck. Clutching his neck, Zednik raced to the Florida bench, leaving a long trail of blood. When he arrived, he nearly fell into the arms of a team trainer, who quickly applied a towel to the cut. Zednik was then helped off the ice by the trainer and teammate Jassen Cullimore, and escorted to the Panthers’ dressing room. “We shouldn’t have finished the game,” Jokinen said. “I saw the replay, that it was my skate that hit him in the throat. I think we were all in shock. I’ve never seen anything like that. There are bigger things than (finishing the game). It was terrifying. “I didn’t think anyone on our team was thinking hockey out there after an injury like that. If it was my call, I would have gone to the hospital with him.” Panthers spokesman Justin Copertino said Zednik was transported by ambulance to Buffalo General Hospital. Copertino said the team was making arrangements to have Zednik’s wife, Jessica, fly from South Florida to Buffalo by a charter flight Sunday night. The team was scheduled to return to Miami, but assistant general manager Randy Sexton and assistant trainer Dave Zenobi planned to stay behind with Zednik, Copertino said. Zednik’s injury left players and coaches on both benches stunned, and a silent hush fell over the crowd at HSBC Arena. NHL vice president Colin Campbell consulted with Sabres general manager Darcy Regier and referee Bill McCreary in a tunnel after Zednik was loaded into an ambulance. Campbell, who was not available for comment, attended the game in part because his son, Gregory, plays for the Panthers. In a statement, the NHL said that Campbell talked to commissioner Gary Bettman and decided to continue the game after knowing that Zednik was stable, that trainers had stopped the bleeding, and that the teams were willing to go on. The league said: “The thoughts and prayers of the NHL family are with Richard Zednik, his loved ones, his teammates and the Florida Panthers organization.” “I can fully understand if they wanted to cancel the whole game,” Sabres coach Lindy Ruff said. “It was pretty solemn. There wasn’t a lot being said (on the bench). There was just more concern for Richard than anything else. “When you see something like that, it isn’t about playing anymore. But I said, ‘We’re going to finish the game and it’s going to be what it’s going to be.’” As crews scraped the blood from the ice and the surface was cleaned by Zambonis during the extended delay, the public address announcer said: “Richard Zednik is in stable condition and on his way to a Buffalo hospital.” The crowd stood in applause during the announcement. Zednik’s injury was eerily reminiscent of an injury sustained by Sabres goaltender Clint Malarchuk about 19 years ago at Buffalo’s Memorial Auditorium. On March 22, 1989, Malarchuk severed his jugular vein when St. Louis Blues forward Steve Tuttle was upended while skating toward the crease, slicing Malarchuk with a skate. Malarchuk required over 300 stitches but spent only one night in the hospital, returning to practice after four days. On April 2, he played the final five minutes in the season finale, less than two weeks after his injury. Panthers defenseman Steve Montador recalled seeing Zednik in a state of shock as he got to the bench. “He looked pale, he was obviously standing and to a degree, coherent. But he didn’t look as focused as you or I right now. He was staring at nothing,” Montador said. “That’s a pretty brave guy to realize what’s going on: Grab your neck and get off the ice.” Zednik has 15 goals and 11 assists this season. It was the second serious injury caused by a skate this weekend. On Saturday, NHL linesman Pat Dapuzzo needed dozens of stitches to close a cut on his face after he was hit by the skate of Philadelphia Flyers forward Steve Downie in a game against the New York Rangers. Dapuzzo, scheduled to retire at the end of the season, didn’t return after the second-period injury.

When looking at the latest NHL standings, many are rather shocked to find that annual bottom feeders of the last few seasons, the Phoenix Coyotes, are currently sitting in 8th spot in the Western Conference.
This surge up the standings should not be attributed to top line offense or good coaching however. In fact, even though the Coyotes have the likes of Shane Doan (17-34-51) and Radim Vrbata (24-18-42) leading their offense, it’s what, or more accuractly WHO is between the pipes that has made the real difference.
Since being acquired from the Anaheim Ducks, Ilya Bryzgalov seems to have found a team that is willing to give him the starting goalie label he desires, and he’s proving his worth by delivering consistent play night after night. Bryzgalov, with 18 wins and 11 losses since joining the Coyotes has a respectable GAA of 2.38 and SV% of 0.920
Phoenix are just 2 points behind defending Stanley Cup champions, the Anaheim Ducks right now, and the way things are going, could pass them in the coming days.
